Formal Notice of Non-Delivery – Demand for Resolution Within 48 Hours
Dear Apple Customer Relations and UPS Claims Department,
This letter serves as a formal notice and demand for immediate action regarding an iPhone that I purchased through the Apple Store USA on July 5, which was scheduled for delivery to my U.S. address by July 7. Despite having paid for the device in full, I have never received it.

The information provided by UPS is contradictory and unacceptable.
UPS falsely reported that two delivery attempts were made with no one available to receive the package. This is simply not true. There were always people present at the residence during the dates and times of the alleged delivery attempts.
UPS then claimed that the package was delivered on July 9 to a person identified as “Amazon,” as shown on the Proof of Delivery. No person by that name resides at my address, nor has anyone at my residence ever received the package. This “recipient” does not exist and raises serious concerns regarding the accuracy of UPS’s delivery records and procedures.
As the seller, Apple remains responsible for ensuring that the purchased product is delivered to the customer. UPS was selected and contracted by Apple to perform the delivery, and any failure, negligence, or misdelivery by UPS cannot be transferred to the customer.
UPS has access to the exact GPS location of the delivery scan, the identity of the driver, delivery route records, timestamps, and all internal documentation related to this shipment. Apple also has the ability to identify whether the iPhone has been activated by using the device’s IMEI and serial number associated with my order. There is therefore no justification for the continued lack of answers regarding the whereabouts of my property.
The facts strongly indicate that this package was either misdelivered, lost, or improperly handled, and I have been left without either the product I paid for or a satisfactory explanation.
Under applicable consumer protection laws, including the obligation to deliver goods as purchased and paid for, I am entitled to receive either the purchased product or an immediate replacement or refund. It is unacceptable that, after payment has been made, the customer is expected to bear the consequences of failures in Apple’s chosen delivery service.
I hereby formally demand that Apple and UPS conclude their investigation and provide a definitive resolution within 48 hours of receipt of this notice.
If this matter is not resolved within that timeframe, I will have no alternative but to pursue all available legal and administrative remedies, including filing complaints with the appropriate consumer protection authorities, initiating legal proceedings, and seeking compensation for all damages resulting from the failure to deliver the purchased product.
It is particularly disappointing that this iPhone was purchased as a birthday gift, and the complete lack of accountability from both Apple and UPS has caused significant inconvenience and frustration.
I expect your written response within 48 hours, confirming Full return of the purchase on my visa credit card.
I Prefer Full refund of the purchase price; becouse the birthday date has gone!
